Next March 21, the controversial new traffic law will be released with which every citizen will have to live and which includes a multitude of changes, on many occasions increasing the amount of fines with the aim of reducing the number of accidents of traffic in our country.


To do this, the General Directorate of Traffic is going to start an aggressive campaign on social networks and the media to publicize the main points and changes that are coming with this new law, among which are fines for using mobile phones, not wearing a seat belt, the removal of the 20 km/h margin for overtaking, and much more.

Not wearing a seat belt

The penalty for not wearing a seat belt is increased from 3 to 4 sanction points, something that also affects not wearing a helmet or not having the corresponding child restraint system installed. The economic fine remains at 200 euros for the offender.

The margin of 20 km/h to overtake on conventional roads disappears

One of the main controversies of the new law is that the margin we had of 20 km/h to overtake on conventional roads disappears.

Use of mobile phone

The fine is increased up to six points on the driver’s license from the previous three for using a mobile phone while driving.

If the telephone were manipulated in circulation but with an adequate support, the sanction would remain at three points. The financial penalty in any case would be 200 euros.

Alcohol rate 0.0 for minors

When the new traffic law comes into force, minor drivers of any vehicle (mopeds, AM permit, motorcycles up to 125cc, bicycles and personal mobility vehicles) will not be able to circulate with an alcohol level greater than 0, both in blood and in expired air. They are exposed to economic sanctions.

Points can be recovered after two years without infractions

The initial balance of points can be recovered if within a period of two years no infractions are committed that involve loss of points on the driving license. Until now, this period necessary to recover the initial balance depended on the infraction committed and its seriousness.

You will not be able to stop or park in the bike lane

The new rule stipulates the prohibition of stopping or parking in bike lanes or bicycle paths. The infraction will be 200 euros.

Overtaking bicycles or mopeds

Thus, on roads with more than one lane in each direction, it will be mandatory to change lanes when overtaking cyclists or mopeds.

On the other hand, overtaking on roads where there is only one lane in each direction will continue to keep a safety distance of at least 1.5 m, but when there are more lanes, a complete change of lane will be mandatory.

If these rules are not respected, the offender is exposed to a loss of six points from the driver’s license.
